International Arbitration & Middle East Legal Experience
Our Head of Legal Practice, whilst working for a prominent Legal 500 law firm in the Middle East, was asked to work on the following international arbitration and construction dispute matters:
- £200M International Airport Arbitration: A government department was involved in a major construction project claim worth over £200 million. This case raised complex issues under the FIDIC form of contract, including defects, extensions of time (EOT), procurement, payment rights, valuation of variations, concurrent delays, and liquidated damages. Our Head of Legal Practice led the team in investigating causes of action, drafting statements of case, and initiating arbitration proceedings.
- Main Contractor Contract Disputes: Advised a well-known main contractor in the construction industry on performance bonds and subcontract termination. The case involved issues under a bespoke contract, including delays, disruptions, and subcontractor financial difficulties.
- MEP Contract Arbitrations: Defended an international main contractor in the early stages of 12 arbitrations under Mechanical, Electrical, and Plumbing (MEP) contracts. These disputes involved payment delays, project disruptions, and termination risks, requiring preparation of ad hoc arbitration agreements and management of the arbitration process.
- Desalination Plant Dispute: Provided legal advice to a plant owner on potential liabilities and risks in relation to government claims involving public utility infrastructure.
- Third-Party Funding in GCC Arbitration: Currently advising on third-party funding methods and evaluating the merits of a large-scale GCC-based construction arbitration claim.
